STATEMENT FROM DR. DENIS MUKWEGE ON ASSET SEIZURE<\/strong><\/p>\n\n\n\n

(LOS ANGELES, CA) Below is a statement from Dr. Denis Mukwege, Founder of the Panzi Hospital and Foundations, in his capacity as the Medical Director. The statement was read by Dr. Mukwege during a press conference at the hospital. The original French language statement is also available. <\/p>\n\n\n\n

On December 31, 2014, the staff of Reference Panzi General Hospital went on strike and took the initiative to organize a peaceful demonstration outside the building of the Directorate General of Taxes (DGI) to denounce the following:<\/p>\n\n\n\n

1. The discrimination against the Hospital.<\/p>\n\n\n\n

Panzi Hospital is a medical facility integrated within the health system of the Democratic Republic of Congo and holds status as a General Reference Hospital. Its employees are therefore agents of the State and, like other personnel of general reference hospitals in the DRC, income taxes on their base salaries are withheld at the source by the Finance Ministry.
Among nearly 500 General Reference Hospitals in the DRC, Panzi Hospital is the only one that has been subjected to a special income tax, a levy on the premium income they receive from the hospital. The employees complain that their hospital is the victim of a blatant discrimination by the DGI and call for tax fairness.<\/p>\n\n\n\n

2. Violation of Human Rights<\/p>\n\n\n\n

The Management of Panzi General Hospital of Reference is extremely concerned about this situation which leads to various violations of human rights: the right to health for the patients, including the right to life for those in need of medicines and other healthcare supplies; but also violation of the right of its employees to receive payment for their work, given that the funds seized were intended to pay the wages of employees and purchase medicine.<\/p>\n\n\n\n

3. Dysfunction of the judiciary system.<\/p>\n\n\n\n

The Panzi General Reference Hospital has filed a lawsuit at the Bukavu Court of Appeals against the DGI, the DRC, and the BCDC (Commercial Bank of Congo), ongoing since November 4, 2014, in connection with the abovementioned violations. The case, originally scheduled for November 18, 2014, was repeatedly postponed due first to a strike of judges, and then the death of a judge on the eve of the hearing date. The hearing has been postponed indefinitely since then.<\/p>\n\n\n\n

Despite the lack of judicial decision on these matters, the DGI took action and seized Panzi General Reference Hospital\u2019s account. With the complicity of the BCDC Bank, the DGI transferred Panzi funds to its account. This was in violation of section 127 of the Congolese Code of Civil Procedure which lists items that are not subject to seizure, including wages.<\/p>\n\n\n\n

4. Irregular tax procedures.<\/p>\n\n\n\n

Tax procedures have been violated by the DGI:<\/p>\n\n\n\n

– In less than ten days, the DGI initiated an official tax order and two demands for payment and collection without the six month deadline provided by law;<\/p>\n\n\n\n

– The DGI has not given Panzi General Reference Hospital an opportunity to contest and mount an administrative appeal.<\/p>\n\n\n\n

There is an extreme urgency to act in the interest of the patients, towards whom we have the responsibility to provide the best health care services, and the Panzi staff, who are unable to receive their wages.<\/p>\n\n\n\n

The Panzi Hospital Management contacted various authorities about this matter but received no satisfactory response up to this day. It remains open for all constructive dialogue with them in order to resolve this crisis.<\/p>\n\n\n\n

The Panzi staff aspires towards justice in recognition of the procedural flaws that make this taxation discriminatory, and still hopes to ensure the proper operation and continuity of services provided by our public health facility.<\/p>\n\n\n\n

En date du 31 d\u00e9cembre 2014, le personnel de l\u2019H\u00f4pital G\u00e9n\u00e9ral de R\u00e9f\u00e9rence de Panzi est entr\u00e9 en gr\u00e8ve et a pris l\u2019initiative d\u2019organiser une manifestation pacifique devant le b\u00e2timent de la Direction G\u00e9n\u00e9rale des Imp\u00f4ts (DGI) en vue de d\u00e9noncer ce qui suit :<\/p>\n\n\n\n

1. La discrimination dont leur H\u00f4pital est victime.<\/p>\n\n\n\n

En effet, l\u2019H\u00f4pital de Panzi est une structure int\u00e9gr\u00e9e dans le syst\u00e8me sanitaire de la R\u00e9publique D\u00e9mocratique du Congo (RDC) et poss\u00e8de le statut d\u2019H\u00f4pital G\u00e9n\u00e9ral de R\u00e9f\u00e9rence (HGR). De ce fait, ses employ\u00e9s sont des agents de l\u2019Etat \u00e0 part enti\u00e8re, \u00e0 l\u2019instar du personnel d\u2019autres HGR de la RDC qui sont soumis \u00e0 un r\u00e9gime fiscal de pr\u00e9l\u00e8vement \u00e0 la source par le Minist\u00e8re des Finances.<\/p>\n\n\n\n

Parmi pr\u00e8s de 500 HGR que compte la RDC, l\u2019H\u00f4pital de Panzi est le seul soumis \u00e0 une mesure fiscale particuli\u00e8re qui est l\u2019imp\u00f4t sur le revenu professionnel. Les agents d\u00e9noncent le fait que leur H\u00f4pital soit victime d\u2019une discrimination flagrante de la part de la DGI et r\u00e9clament une \u00e9quit\u00e9 fiscale<\/strong>.<\/p>\n\n\n\n

2. Violation des droits de l\u2019Homme.<\/p>\n\n\n\n

La Direction de l\u2019HGR\/Panzi est extr\u00eamement pr\u00e9occup\u00e9e par cette situation qui entra\u00eene par voie de cons\u00e9quence diverses violations des droits humains : droit \u00e0 la sant\u00e9 pour les malades, dont le droit \u00e0 la vie est mis en p\u00e9ril \u00e0 d\u00e9faut d\u2019approvisionnement en m\u00e9dicaments et autres fournitures n\u00e9cessaires pour prodiguer des soins, mais aussi violation du droit de ses agents \u00e0 percevoir leur r\u00e9mun\u00e9ration pour leur travail prest\u00e9, \u00e9tant donn\u00e9 que le montant saisi par la DGI \u00e9tait destin\u00e9 \u00e0 la paie des agents et \u00e0 l\u2018approvisionnement de l\u2019h\u00f4pital en m\u00e9dicaments.<\/p>\n\n\n\n

3. Dysfonctionnement de l\u2019appareil judiciaire.<\/p>\n\n\n\n

L\u2019HGR\/Panzi a assign\u00e9 en justice devant la Cour d\u2019Appel de Bukavu la DGI, la Banque commerciale du Congo (BCDC), et l\u2019Etat congolais depuis le 04 Novembre 2014 en rapport avec ces violations sus \u00e9voqu\u00e9es. L\u2019affaire fix\u00e9e initialement le 18 Novembre 2014 a \u00e9t\u00e9 successivement report\u00e9e suite d\u2019une part<\/p>\n\n\n\n

\u00e0 la gr\u00e8ve des magistrats, et d\u2019autre part suite au d\u00e9c\u00e8s d\u2019un magistrat de la Cour \u00e0 la veille de la date d\u2019audience. Cette derni\u00e8re a \u00e9t\u00e9 renvoy\u00e9e sine die<\/em>.<\/p>\n\n\n\n

Malgr\u00e9 l\u2019absence de d\u00e9cision judiciaire li\u00e9e \u00e0 ces dysfonctionnements, la DGI a proc\u00e9d\u00e9 \u00e0 la saisie effective du compte de l\u2019HGR de Panzi, en violation de l\u2019article 127 du Code de proc\u00e9dure civile congolais qui \u00e9num\u00e8re une liste de biens qui ne sont pas susceptibles de saisie, qui inclut le salaire.<\/p>\n\n\n\n

4. Vices de proc\u00e9dures fiscales.<\/p>\n\n\n\n

La proc\u00e9dure fiscale pr\u00e9vue par les dispositions l\u00e9gales a \u00e9t\u00e9 viol\u00e9e par la DGI :<\/p>\n\n\n\n

– En moins de dix jours, elle a activ\u00e9 une taxation d\u2019office, deux avis de mise en recouvrement et les commandements ; sans respect des d\u00e9lais de six mois pr\u00e9vus par la loi.<\/p>\n\n\n\n

– Elle n\u2019a pas accord\u00e9 \u00e0 l\u2019HGR\/Panzi la possibilit\u00e9 de jouir de droit d\u2019opposition et de recours administratif.<\/p>\n\n\n\n

Il y a une urgence extr\u00eame \u00e0 agir, dans l\u2019int\u00e9r\u00eat des malades dont nous avons la responsabilit\u00e9 d\u2019apporter les meilleurs services de sant\u00e9, et pour le personnel de Panzi, qui n\u2019a pas pu percevoir sa r\u00e9mun\u00e9ration.<\/p>\n\n\n\n

La Direction de l\u2019HGR\/Panzi a contact\u00e9 les diff\u00e9rentes autorit\u00e9s impliqu\u00e9es sans obtenir une r\u00e9ponse satisfaisante \u00e0 ce jour et demeure encline \u00e0 entamer un dialogue constructif avec ces derni\u00e8res pour sortir de cette crise.<\/p>\n\n\n\n

Le personnel de Panzi aspire \u00e0 voir la justice reconna\u00eetre les vices de proc\u00e9dure qui rendent cette imposition discriminatoire et garde l\u2019espoir d\u2019assurer le bon fonctionnement et la continuit\u00e9 des services fournis par notre structure sanitaire publique.<\/p>\n\n\n\n
